Medytox (086900) has raised its damages claim against Daewoong Pharmaceutical (069620) in an ongoing trade secret infringement lawsuit to 500 billion won from 50 billion won, a tenfold increase. The move reflects additional sales volumes and revenue from the allegedly infringing products that were confirmed during the appeal.
Medytox said on the 3rd that it had filed an application to amend the scope and grounds of its claim in the appellate proceedings at the Seoul High Court, where it is pursuing an injunction against trade secret infringement and damages from Daewoong Pharmaceutical and other defendants.
The company said the revised claim reflects the sales volumes and revenue of Daewoong Pharmaceutical's infringing products confirmed from 2014 through July 31, 2025, an extended period for calculating damages, and punitive damages provisions under relevant law.
Medytox added that it calculated the damages by taking into account the evidence gathered to date, what it described as Daewoong Pharmaceutical's willful infringement of trade secrets, and the punitive damages provisions of the Unfair Competition Prevention Act.
Under the current Unfair Competition Prevention Act, damages can be increased up to threefold for losses incurred after July 9, 2019, and up to fivefold for losses incurred after Aug. 21, 2024. The court, however, decides whether and to what extent those provisions apply.
Medytox is seeking 500 billion won through what is known as an explicit partial claim, in which a plaintiff first claims part of the total amount it believes it is entitled to. Losses incurred after Aug. 1, 2025, were not included in the current calculation.
"This revision brings the scope of our claim in line with reality, reflecting the sales volumes and revenue additionally confirmed during the appeal, the extended period for calculating damages and the relevant statutes," a Medytox official said. "Because the strain and the manufacturing process are core technological assets built up through years of research, development and investment, we will thoroughly present the arguments and evidence needed to protect the rights of the company and its shareholders."
