South Korea's Personal Information Protection Commission (PIPC) will deliberate on July 29 the level of sanctions to be imposed on KT Corp. over a personal data breach caused by an illegal small-cell base station attack last year.
​According to industry sources on July 27, the PIPC will hold a plenary meeting on July 29 to review and vote on a corrective order covering whether KT violated the Personal Information Protection Act (PIPA) and whether administrative fines should be imposed.
​In previous large-scale personal data breach cases involving SK Telecom and Coupang, the commission approved corrective measures on the same day as its plenary review. As a result, a final decision on KT is also expected to be made on July 29.
​However, the decision could be postponed to a subsequent plenary meeting if commissioners determine that additional review is required regarding the facts of the case or the methodology used to calculate the administrative fine.
​In September last year, an attack exploiting an illegal femtocell resulted in the leakage of personal information linked to 22,227 KT subscriber lines, including International Mobile Subscriber Identity (IMSI) numbers, International Mobile Equipment Identity (IMEI) numbers and phone numbers.
​Among the affected users, 368 victims suffered a total of 777 unauthorized micropayment transactions amounting to approximately 243 million won, according to the investigation.
​The PIPC has also conducted an additional investigation into the BPFDoor malware infection affecting KT's servers and the company's response to the incident, alongside the femtocell-related data breach.
​During the deliberations, the commission is expected to examine whether KT properly implemented the technical and administrative safeguards required to protect personal information and whether it appropriately reported the breach and notified affected users after the incident.
​Under PIPA, companies that violate their obligations to safeguard personal information may face administrative fines of up to 3% of their total revenue. The applicable revenue is based on the company's average revenue over the previous three years, excluding sales unrelated to the violation.
​Based on that methodology, KT's wireless service revenue averaged 6.4955 trillion won annually over the past three years. Applying the maximum 3% rate to the entire wireless service revenue would result in an administrative fine of approximately 194.8 billion won.
​However, that figure is only a simple calculation. The actual amount of any administrative fine will be determined after considering the scope of revenue recognized by the PIPC as related to the violation, the severity of the misconduct, the scale of damages, the company's response to the incident, and any mitigating or aggravating factors.
