LG新能源在美国对亿纬锂能提起电池专利诉讼并申请ITC进口排除令

LG Energy Solution (373220.KS) has filed a patent lawsuit against Chinese battery maker EVE Energy in the United States. The move is part of LG Energy Solution's strategy to expand its patent infringement litigation front to the US and strengthen measures to protect its patents.
Tulip Innovation said on the 22nd that LG Energy Solution filed an import exclusion request and a patent infringement lawsuit against EVE Energy and others with the US International Trade Commission (ITC) and a Texas district court. Tulip Innovation is LG Energy Solution's patent management company.
The lawsuit targets a total of five patents, including four cylindrical battery patents covering tabless technology and one separator-related patent. LG Energy Solution determined that EVE Energy's batteries applying the infringed patents are widely used in the US power tool market.
In particular, LG Energy Solution is also pursuing ITC litigation against power tool customers that receive battery supplies from EVE Energy. If LG Energy Solution wins the ITC case, the affected products would be subject to measures including an import exclusion order banning their entry into the US and a cease-and-desist order prohibiting the sale and distribution of products already circulating in the US.
LG Energy Solution has been filing a series of patent infringement lawsuits against Chinese companies across the globe. Last year in Germany, it won multiple infringement suits against Chinese lithium-ion battery maker Sunwoda over patents including an "electrode assembly structure patent." The German court ordered a ban on sales of batteries applying the technology, the recovery and disposal of remaining batteries, and damages.
"Filing this new enforcement action swiftly demonstrates our commitment to addressing the spread of unlicensed lithium-ion battery products across the industry and to maintaining a market based on fair competition," said Giustino De Sanctis, CEO of Tulip.
