韩国法院判令SK集团会长崔泰源向前妻支付9440亿韩元财产分割款

A court ruled that SK Group Chairman Chey Tae-won, 65, must pay Noh So-young, 65, director of the Art Center Nabi, 944 billion won in asset division.
944 Billion Won Asset Division, and the Basis
According to legal circles on the 24th, the Seoul High Court's Family Division 1 (presiding judge Lee Sang-joo) ruled at the sentencing hearing on remand held at 2 p.m. that day that Chairman Chey must pay director Noh 944 billion won in asset division.
The court included the SK shares held by Chey in the subject of asset division, while dividing them at a ratio of two-thirds for Chey and one-third for Noh. Accordingly, the court had Chey pay the shortfall in Noh's share of the stock in cash.
The base date for calculating the value of the shares subject to division was set as April 16, 2024, the date the fact-finding arguments in the divorce lawsuit concluded.
The court stated, "SK's stock price rose significantly between the conclusion of arguments in the appellate trial and the conclusion of arguments in the trial on remand, but it cannot be seen that Chairman Chey's managerial contribution had no effect on this," while adding, "For the fair distribution of the couple's joint property, the circumstance of the rising stock price was reflected in calculating the ratio."
In line with the intent of the Supreme Court ruling last October, the court did not regard the 300 billion won slush fund of Noh's late father, former President Roh Tae-woo, as a contribution by Noh's side, even if it had flowed to SK. Shares that Chey gifted to relatives before the breakdown of the marriage, for the purpose of maintaining management control and managerial activities, were also excluded from the subject of division.
Nine Years of Legal Battle, Finally Concluded
With this ruling, the legal dispute between the two sides, which began in July 2017 when Chey filed for divorce mediation, reached a conclusion after nine years.
The two, who married in September 1988 and have three children, parted ways in 2015 when Chey announced through the media the existence of a child born out of wedlock. Chey filed for divorce mediation in 2017, but when it broke down, he filed a formal lawsuit, and Noh responded with a countersuit in December 2019.
The first trial in December 2022 awarded 100 million won in consolation money and 66.5 billion won in cash for asset division, but the second trial in May 2024 significantly raised the amounts to 2 billion won in consolation money and 1.3808 trillion won in asset division, recognizing former President Roh's slush fund contribution and other factors.
Last October, the Supreme Court sent the case back on remand, ruling that an illegal slush fund could not be taken into account as a contribution to asset division. At that time, the 2 billion won consolation money portion was confirmed as is, and this trial on remand re-examined only the asset division.
Immediately after the ruling, Chey's legal representative said in a statement, "In the nearly 20-year process of dissolving the marriage, the divorce was finalized by the Supreme Court ruling last year, and today there was a ruling in the trial on remand for asset division," adding, "Chairman Chey feels sorry for causing concern to many people throughout this process." He further added, "We will state our specific position on the ruling after closely reviewing the judgment."
