An Aboriginal group has appealed the amount of compensation it was awarded for cultural harm and economic loss linked to iron ore mining by Fortescue Ltd. in Western Australia, and is seeking to boost the payout significantly.

The Yindjibarndi traditional owner group was awarded A$150 million ($108 million) after suing the company, which had mined their land without permission and destroyed or damaged hundreds of culturally-significant sites.

The amount the Federal Court of Australia in May ordered Fortescue to pay was a lot lower than the A$1.8 billion they had sought.

The group lodged a native title claim to the area in 2003. Fortescue did not wait for it to be heard and began mining, raking in billions in revenue from the land as China’s industrialization unleashed soaring demand for iron ore, the key ingredient for steel.

The Yindjibarndi Ngurra Aboriginal Corporation lodged an appeal to the May ruling with the Full Court of the Australian Federal Court this week.

“Our appeal addresses the Court’s rejection of a royalty-based measure of compensation for economic loss and its application of freehold value to our native title rights based on pastoral rather than mining use,” Yindjibarndi Group Chief Executive Officer Michael Woodley said in a statement.

Fortescue is the world’s fourth-biggest iron ore producer, with Executive Chairman and Founder Andrew Forrest’s fortunes tied to the iron ore boom of the early 2000s.

A spokesperson for Fortescue declined to comment when contacted.
