Three funds affiliated with Bracebridge Capital LLC have filed an involuntary petition for a Chapter 11 against a Braskem entity they lent to.
The unit in question is Braskem America Finance Company, the issuer of around $587 million outstanding bonds due in 2041, according to a filing on Wednesday. The three funds, whose investment adviser is Bracebridge, said they collectively hold $272 million of that debt.
The troubled Brazilian petrochemicals firm has been attempting since August to negotiate an out-of-court restructuring with its creditors for its around $11 billion debt pile.
The move by the Bracebridge-linked funds raises the pressure for Braskem. The three creditors filed the involuntary petition on the basis that Braskem hasn’t generally been paying its debts as they come due. The borrower under law has the option to consent to the bankruptcy filing, or fight the petition.
Braskem creditors earlier this month shunned another restructuring proposal by the company, in which shareholders pledged about $1 billion in fresh capital to backstop a follow-on offering, but only if the company is able to slash its debt significantly through the restructuring.
Braskem has reportedly been negotiating another proposal since with a group of bondholders, to avert a full-blown bankruptcy.
