Italy's largest utility Enel has hired a New York law firm that previously represented U.S. President Donald Trump's former personal lawyer Rudy Giuliani and adviser Steve Bannon to defend it from a $3.3 million lawsuit brought by Davis Polk & Wardwell over allegedly unpaid legal fees.
Gary Lerner, a partner at Davidoff Hutcher & Citron, filed an appearance on Tuesday on behalf of Enel North America and two of its affiliates in New York state court. Davis Polk has alleged that Enel owes money for its legal work on a $200 million contract dispute that was triggered by a catastrophic winter storm in Texas in 2021.
Enel said in a statement that it "completely rejects" Davis Polk's allegations, and that the firm's lawsuit is a "complete mischaracterization of the facts."
"Davis Polk absolutely failed us as attorneys," Enel said.
A spokesperson for Davis Polk did not immediately respond to a request for comment. The firm previously told Reuters that the lawsuit is a "straightforward case over Enel’s failure to fulfill a contractual obligation."
Enel's High Lonesome subsidiary had entered into a derivative contract with an affiliate of financial services company Allianz. The contract was designed to hedge weather risk at High Lonesome's West Texas wind farm.
After Winter Storm Uri knocked out power to millions of people living in Texas in February 2021, calculations under the agreement indicated High Lonesome owed Allianz more than $125 million, Davis Polk said in its complaint. Allianz sued High Lonesome in 2022.
Davis Polk said Enel stopped paying its legal bills in the Allianz case in late 2024. By June 2025, Enel had racked up millions in unpaid legal fees for more than 2,000 hours of work by Davis Polk attorneys, the law firm alleged in its lawsuit.
Enel said in its statement that Davis Polk's legal invoices "contained countless examples of overbilling" and that the firm performed "unnecessary and unjustified work" billed at "exorbitant" rates, leading the company to hire new legal counsel. Davis Polk's lawsuit said Enel never raised any objections with its work.
Davidoff Hutcher represented Giuliani in federal and state investigations into Trump's attempts to overturn the results of the 2020 U.S. presidential election, an investigation into Giuliani's business and political activities in Ukraine and a U.S. congressional panel's inquiry into the January 6, 2021, attack on the U.S. Capitol by Trump supporters. The firm also represented Bannon after he was subpoenaed by the congressional panel investigating January 6, and in his criminal contempt trial after he defied the subpoena.
Davidoff Hutcher later sued both Giuliani and Bannon for unpaid legal fees. A New York judge ordered Giuliani in September 2025 to pay the firm $1.36 million plus interest, while Bannon ultimately settled the dispute after being ordered by a judge to pay more than $480,000 in fees.
