不做 NCSoft(036570.KS)
Kakao Games(293490.KQ)

NC has suffered another defeat in its game copyright dispute against Kakao Games. Following its loss in the ArcheAge War lawsuit in March, the company has now also lost its copyright case over ROM: Remember of Majesty and said it will appeal the ruling.
On July 9, the Civil Agreement Division 62 of the Seoul Central District Court ruled against NC in its lawsuit seeking to prohibit alleged copyright infringement by RedLab Games and Kakao Games. The decision came about two years and five months after NC filed the lawsuit on Feb. 22, 2024.
ROM: Remember of Majesty, released on Feb. 27, 2024, was developed by RedLab Games and published by Kakao Games. Five days before the game's launch, NC filed suit against both companies, alleging that ROM infringed the copyright of Lineage W.
NC argued that ROM copied gameplay systems inherited by Lineage W from Lineage M, including its transformation system, magic doll system and equipment enhancement system. The court, however, held that while those systems may contain creative elements, they are not protected under copyright law.
The court also found that the release and distribution of ROM by RedLab Games and Kakao Games did not constitute copyright infringement of Lineage W and did not amount to unfair competition through misappropriation of business achievements.
The ruling marks another setback for NC in its legal disputes with Kakao Games. In March, the company also lost the second-instance appeal in its copyright lawsuit against Kakao Games and its subsidiary XL Games over ArcheAge War.
NC said it plans to appeal the latest first-instance ruling.
"We will carefully review the court's written decision and seek a new judgment from a higher court," an NC spokesperson said.
Separately, NC is pursuing a final appeal in its copyright case against Kakao Games and XL Games over ArcheAge War, as well as a Supreme Court appeal in its lawsuit against Webzen over alleged copyright infringement involving R2M and Lineage M.
