DraftKings (DKNG.O) sued Philadelphia on Thursday to block it from enforcing a local consumer protection law, after receiving a subpoena in connection with an investigation into the sports betting company.
In a complaint filed in Philadelphia federal court, DraftKings said a 2024 local law creating a municipal enforcement scheme to protect consumers conflicted with Pennsylvania state law.
DraftKings wants a declaration that Philadelphia's law was preempted by the state's law governing consumer protection and unfair trade practices, and was unenforceable when applied to the company's licensed gaming activities under a different state law.
The City of Philadelphia Law Department issued the subpoena in April. It did not immediately respond to requests for comment. DraftKings and its lawyers did not immediately respond to similar requests.
