Wall Street ends higher on tech stocks, falling oil prices, and bond market rally
NEW HAVEN, Conn. - The U.S. District Court for the District of Delaware entered judgment Monday in favor of Biohaven Ltd. (NYSE:BHVN) and Yale University in their trade secret misappropriation and breach of contract litigation against Avilar Therapeutics, Inc. and RA Capital Management GP, LLC, according to a press release statement.
The judgment formalizes a combined $4 million award following a jury verdict from July 24. Judge Jennifer L. Hall entered the judgment reflecting the jury’s findings that RA Capital and Avilar willfully and maliciously misappropriated a Yale trade secret relating to its MODA targeted protein degradation platform, and that RA Capital breached its 2019 confidentiality agreement with Yale.
The court awarded $2 million to Yale for RA Capital’s breach of contract and $1 million each to Yale and Biohaven for trade secret misappropriation.
Yale professor Dr. David Spiegel developed the MODA platform, designed to bind and eliminate disease-causing extracellular proteins, and presented it at Yale’s Lifesciences Pitchfest in 2018. RA Capital entered into a confidentiality agreement with Yale in April 2019 to evaluate a potential investment in the technology.
Dr. Spiegel shared confidential technical information with RA Capital during negotiations that ended without agreement in August 2019. Biohaven and Yale alleged that RA Capital, together with Avilar Therapeutics, used confidential information to build a competing drug development program.
Biohaven licensed the MODA platform from Yale to develop and commercialize the technology. The companies filed suit in March 2023 in the U.S. District Court for the District of Delaware. The jury trial began on July 20.
The parties may file post-trial motions, and the judgment remains subject to the court’s consideration of those motions.
