Rivian Automotive (RIVN) is seeking a refund in the “tens of millions of dollars” from the U.S. government for tariffs the electric vehicle manufacturer paid and now claims were “contrary to law,” seeking a remedy the Supreme Court decision does not provide.
The lawsuit filed in the U.S. Court of International Trade names Customs and Border Protection and its commissioner, Rodney Scott, as defendants, along with the U.S. government.
While the Supreme Court ruled that tariffs imposed by the Trump Administration under the International Emergency Economic Powers Act (IEEPA) were invalid, the ruling leaves the determination of refunds to the lower courts. This has triggered a flurry of lawsuits to claw back tariffs that were paid between April 2025 and July 2026. Of the more than $120B in potential refunds, a little over half has been returned.
