Legalized sports betting efforts in California have seen some recent momentum as the rise of prediction markets changes the backdrop.
Notably, California tribal leaders are aiming for a 2028 ballot measure to legalize online sports betting, according to Legal Sports Report. California Nations Indian Gaming Association Chair James Siva said during a podcast last week that tribes continue to view 2028 as the target for placing a sports betting ballot initiative back on the ballot for voters to decide. "We’ve built up a huge amount of positive feelings for tribal gaming," Siva said. "We keep our promises, do the right thing, and offer safe and regulated gaming," highlighted Siva.
The efforts to legalize sports betting in the most populous state in the nation go back more than six years. In 2019 and 2020, California lawmakers and tribal groups explored ways to put sports betting on the ballot, but the plans did not advance cleanly. California lawmakers tried to negotiate a deal in 2020, but it fell apart before voters could weigh in. Tribal gaming interests, card rooms, and commercial operators all had different visions for regulation.
The biggest attempt at legalization arrived in 2022, when two competing initiatives reached the ballot. Proposition 26 would have allowed in-person betting at tribal casinos and horse tracks, while Proposition 27 would have allowed online and mobile betting outside tribal lands. However, both campaigns spent heavily attacking each other, and voters rejected both measures overwhelmingly.
Looking ahead, California tribes are offering their proposal as a safer, age-restricted, state-regulated alternative that they maintain is clearly better for the state than the prediction markets industry. Sportsbook operators such as DraftKings (DKNG), FanDuel (FLUT), and BetMGM (MGM) (GMVHF) could benefit, but probably only if the sports betting framework allows partnerships with tribes or other license pathways similar to prior California proposals.
