- OIRA显示DHS/USCIS题为Fee for Certain H-1B Petitions的拟议规则完成EO 12866审查,状态为Proposed Rule且Economically Significant。

The Department of Homeland Security proposed a new $103.3K fee on all H-1B cap-subject petitions, including those for advanced-degree holders, in a rule that would generate roughly $8.8B a year for the federal government's immigration system.
The fee, unveiled Monday in a notice of proposed rulemaking, would apply at the time of filing and stack on top of all other required charges.
Unlike President Donald Trump's earlier $100K H-1B proclamation, which a federal court vacated in June and remains on appeal at the First Circuit, the new fee is issued through formal rulemaking and would hit workers already inside the U.S., not just new hires from abroad.
DHS is splitting the projected revenue across six federal players: U.S. Citizenship and Immigration Services would keep 34.2%, or $3B, partly to cover a $1.2B transfer of costs off its premium-processing account.
The Executive Office for Immigration Review, which runs immigration courts, would get 33.7%, or nearly $3B, to fund 8,400 new positions.
The Department of Labor would receive 13.8% for wage and labor-certification enforcement, Immigration and Customs Enforcement 11.9% for vetting, the State Department 5.5% for consular fraud screening, and Customs and Border Protection under 1%.
DHS estimates the rule would significantly affect more than 11K small businesses, 76% of small entities that filed cap-subject petitions in fiscal 2025, while betting that demand for the capped 85K annual visa slots won't fall below that threshold even at the higher price.
