South Korea’s Defense Acquisition Program Administration (DAPA) is set to determine sanctions in a defense procurement corruption case involving LIG Defense & Aerospace (LIG D&A) and DAPA officials, linked to projects worth 1.7 trillion won.
DAPA will convene its Contract Review Committee on Oct. 20 to consider alleged violations, including bribery and cost-related fraud.
Bribery is treated as the most serious offense under the agency’s sanctions review rules, raising expectations that LIG D&A could face restrictions on its eligibility to participate in government tenders.
All 27 bribery-related sanctions imposed since DAPA’s establishment have resulted in bidding restrictions.
The Contract Review Committee determines sanctions under government procurement regulations, including bidding restrictions and financial penalties against companies found to have engaged in improper conduct.
It also addresses contract performance and adjustments to liquidated damages for delays. The committee includes DAPA officials and external private-sector experts who jointly determine the severity of sanctions.
In August, prosecutors said LIG D&A had provided money and other benefits to key DAPA officials in connection with six projects, including those involving the Korea Research Institute for Defense Technology Planning and Advancement.
According to prosecutors’ findings, the bribes and other benefits provided by LIG D&A totaled approximately 460 million won.
The case represents the largest corruption scandal uncovered since DAPA was established in 2006.
DAPA has emphasized its commitment to taking strict action.
During a parliamentary audit by the National Assembly’s Defense Committee on Oct. 13, DAPA Commissioner Lee Yong-cheol said the case had “dealt an extremely serious blow to the reputation of the organization.”
“We must respond firmly to ensure that such incidents never happen again,” Lee said.
Some industry observers are closely watching the potential consequences of a bidding ban on LIG D&A.
The bribery case remains in its first trial, and LIG D&A has directly challenged the prosecution’s findings. It is unusual for a company indicted on corruption charges to actively dispute the results of a prosecutorial investigation.
A bidding restriction could affect not only DAPA contracts but also other government-funded research and development projects.
Lee acknowledged these concerns, saying, “We are carefully considering the sanctions because they could cause significant disruptions to the deployment of military capabilities.”
Ahead of the Contract Review Committee meeting, LIG D&A carried out an organizational restructuring that replaced four of its seven business division heads.
The company also established a compliance audit office to strengthen internal controls, focusing its restructuring on reinforcing its compliance management framework.
